There is a well-developed literature on trust. In his important article Faulkner, 424−429, 2015) distinguishes three-place, two-place and one-place trust predicates. He then argues that our more basic notions of trust are expressed by the one-place and two-place predicates. Three-place trust, contractual trust, is not fundamental. This matters. Having a clear understanding of our concepts of trust is important. The most important assumption of Faulkner’s argument is that the notion of trust expressed by the three-place predicate is not (...) attitudinal; it is a ‘metaphysical hybrid of attitude and action’. I argue that this is wrong. All three notions are attitudinal and no reason exists to deny that the one-place and two-place notions derive from the three-place one. Once one rejects Faulkner’s assumption that the three-place notion can be separated off from the others as a metaphysical hybrid argument for the priority of the one-place and two-place notions collapses. lthough it was in the early eighties when I began to feel a growing disaffection with the radicalized academic left, a decisive nausea—inducing body blow was administered by the PMLA of january 1989. In that infamous issue appeared a letter signed by twenty-four feminist academics attacking the eminent Shakespeare scholar Richard Levin, for "Feminist Thematics and Shakespearean Tragedy," which had appeared in PMLA the year before. Levin’s essay, the work of a well-tempered, open-minded, and liberal supporter of many radical reforms (...) in the academy, was a penetrating critique of the feminist identity politics that were trying to wrest Shakespeare into the persona of a feminist scourge of sexism and patriarchy. Levin’s temerity in taking on the distortions of identity politics was threatening enough, but his Enlightenment style and Swiftian wit, which he brilliantly deployed to dismantle the tendentious and self—serving hermeneutics of the "dictatorship of virtue" (a phrase I borrow here from Richard Bernstein) that constitutes avant-garde millenarianism in the U.S. academy, served further to inflame the hypersensitive skins of his holier-than-thou critics, who brook no criticism.. Since the introduction of the U.S. Sarbanes-Oxley Act in 2002 and several other national corporate governance codes, whistleblowing policies have been implemented in a growing number of companies. Existing research indicates that this type of governance codes has a limited direct effect on ethical or whistleblowing behaviour whereas whistleblowing policies at the corporate level seem to be more effective. Therefore, evidence on the impact of (inter)national corporate governance codes on the content of corporate whistleblowing policies is important to understand their (...) indirect impact on whistleblowing behaviour. This study analyzes the contents of whistleblowing policies, and parts of corporate codes of conduct and codes of ethics, describing such policies of 56 leading European companies. By classifying the contents in seven categories, an exploratory framework was created. General contents often identified were: applicability to all employees, a group-wide scope and an authoritative tone. The most common general violations to report were breaches of internal policies and external regulations or laws. The more specific violations most frequently mentioned were criminal offences and dangers to health and safety or the environment. Contacts to report to were the direct or indirect supervisors, a compliance officer or a confidential "hotline" facility. A confidentiality guarantee was common and anonymous reporting was often possible, though sometimes discouraged. Protection against retaliation is stated by ensuring that retaliation will not happen, prohibiting it or making it punishable. The requirement of good faith was frequently given. Finally, investigation of the report was often guaranteed. Surprisingly little information is given on the treatment of whistleblowers reporting an unfounded complaint in good faith, or reporting a violation they were involved in. The study's findings are most relevant to companies without a whistleblowing policy or those that intend to benchmark their policies, and to pan-European standard setters. (shrink)

The pleasures experienced by boys and men who work and play closely with technology have important implications for both gender and technology. This article presents empirical evidence on the topic from two studies: one of hobbyist “robot builders” who build machines for the U.K. television program Robot Wars, the other of professional software developers working in a large U.S. corporation. In spite of the obvious differences between these two groups, they experience strikingly similar pleasures—in creating technologies, in their skills and (...) knowledge, and in their intimacy and comfort with technology. The authors discuss available gender-based analyses of men’s pleasures in technology, drawing on the empirical material to both challenge and extend these analyses. The authors suggest, tentatively, that technology is a gender-authentic and gender-available avenue for those men who particularly crave certainty because technology appears more certain, easier to understand, and easier to master than other worlds they inhabit. The article presents and analyzes different approaches of U.S. bioethicists in comprehending the Nazi medical crimes after 1945. The account is divided into two sections: one dealing with discussions on research ethics and the Nuremberg Code up until the 1970s and the other ranging from the 1970s to the present and highlighting bioethics' engagement with Nazi analogies. The portrayal of different bioethical scholars, institutions, and documents—most notably Henry K. Beecher, Jay Katz, the Belmont Report, the Hastings Center, Arthur L. Caplan, (...) and Robert M. Veatch—provides a nuanced interpretation of the motives that bioethicists held and the strategies that they applied to establish an understanding of the Nazi medical crimes and their relation to contemporary bioethical issues. In this, the different approaches shared a common goal: To integrate the Nazi medical crimes into an ethical framework by means of selective acknowledgments and representation of their history. A central problem for the international governance of heritable germline gene editing is that there are important differences in attitudes and values as well as ethical and health care considerations around the world. These differences are reflected in a complicated and diverse regulatory landscape. Several publications have discussed whether reproductive uses would be legally permissible in individual countries and whether clinical applications could emerge in the context of regulatory gaps and gray areas. Systematic comparative studies that explore issues related to (...) the governance of this technology from different national and international perspectives are needed to address the lack of knowledge in this area. In this research report, we contribute to filling this gap by presenting views of stakeholders in the United Kingdom on challenges to the governance of heritable genome editing. We present findings from a multistakeholder study conducted in the United Kingdom between October 2016 and January 2018 and funded by the Wellcome Trust. This research included interviews, literature analysis, and a workshop. We involved leading U.K. scientists, in vitro fertilization clinicians, and representatives from regulatory bodies, patient organizations, and other civil societal organizations, as well as fertility companies. Part one of this article explores stakeholder perceptions of possible global developments in heritable genome editing and associated risks and governance challenges. Part two presents a range of policy options that were generated during the workshop in relation to the challenges discussed in part one. (shrink)

Meslin and Harold T. Shapiro On 3 October 2001, Executive Order 12975 expired, and with it so too did the National Bioethics Advisory Commission (NBAC). Established by President Bill Clinton in 1995, NBAC was the fifth national committee since 1974 created to advise the U.S. (...) government on bioethics policy. In the long political tradition in this country that national bioethics policy advice should use temporary rather than permanent bodies, NBAC followed in the footsteps of the National Commission for the Protection of Human Subjects of Biomedical and Behavioral Research (1974-78); the President's Commission for the Study of Ethical Problems in Medicine and Biomedical and Behavioral Research (1980-83); the Ethics Advisory Board (1978-80); and the Biomedical Ethics Advisory Committee (1988-89). Arguably, other distinguished panels could lay claim to recognition as a "national bioethics committee" including the Advisory Committee on Human Radiation Experiments (ACHRE) (1994-95); the Fetal Tissue Transplantation Research Panel (1988); the Human Embryo Research Panel (1994); and the National Institutes of Health (NIH) Recombinant DNA Advisory Committee (RAC), which continues to function.These committees and commissions form a kind of a continuum, albeit occasionally interrupted by periods during which no such bodies existed. Each arose from a particular confluence of events and circumstances. NBAC was no different; its history can be traced both to a series of discussions within the White House Office of Science and Technology Policy beginning in 1993 (NBAC 1998a, p. 3), and to a specific recommendation from ACHRE that called for a national committee to address ethical issues in human subjects research (ACHRE 1995, p. 817). Nbac's Impact In his useful comparison of the accomplishments of the National Commission and the President's Commission, Brad Gray concluded that seven lessons were learned, the sixth of which was that "nothing substitutes for having a perceptible impact on either policy or practice" (Gray 1995, p. 304). Assessing NBAC's [End Page 95] impact on "policy or practice" is difficult, particularly given the fact that it so recently completed its work. More time may be needed before a full assessment can be undertaken of the impact of its six reports (and their total of 120 recommendations). Instead, in this essay we offer some reflections on NBAC's initial impact, using some specific examples of how bioethics gets done Inside the Beltway. Eliciting Reaction If immediate reaction by the White House is any measure of impact, then Cloning Human Beings (NBAC 1997) had a significant one. The day after he received this report in a Rose Garden ceremony, President Clinton submitted a bill to Congress that would have extended the moratorium on federal funding to create a child using somatic cell nuclear transfer. This bill never passed, nor has any other bill emerged that has enjoyed the support of the House and the Senate. Five states have enacted legislation to date, but these vary in their permissibility from bans on all forms of cloning to bans similar to the one proposed by NBAC, which recommended a time-limited prohibition only on somatic cell transfer to create a child (reproductive cloning).If the Cloning report elicited speedy action from the White House, this paled in comparison to the reaction that led to and, in turn, was created by Ethical Issues in Human Stem Cell Research (NBAC 1999a). Those who believe that government moves slowly need only be reminded of the events of 8-14 November 1998 (and, as we shall mention below, the further events of 14 July 1999). Some will recall that early in the second week of November 1998, James Thomson and his colleagues published in Nature and John Gearhart and his colleagues published in the Proceedings of the National Academy of Sciences that they had isolated and cultured human primordial stem cells and germ cells respectively. The advent of the post-Stalin "thaw," particularly the period after 1956, was marked by a spectacular expansion in the publishing of translated Western writing and also, on occasion, of editions in the original languages: the virtual ban on import of Western books was, as of 1975, never relaxed. The more permissive political atmosphere favored the publication of a vastly larger variety of Western authors and titles and provision for the Soviet public of much larger quantities of such books in the (...) country's bookstores and libraries. While the improvement was very impressive in itself, abundant data attest that it was far from adequate to satisfy reader demand.1 Among the beneficiaries, books by American authors stood out the more prominently since it was these that were most discriminated against during the years immediately preceding.2 Decades of neglect, to say nothing of politically inspired selectivity, resulted in such incongruities as the first Russian translation of Melville's Moby Dick in 1961—more than a century after the novel's appearance—and the first Soviet publication of any work by Henry James in 1973. It was not until the 1960's that Russians had an opportunity to read Faulkner—but then, the same was true of Kafka. However unevenly, the range of American literature, both old and new, now made available to Soviet readers is gradually expanding. · 1. Faced with evidence that what a person said is false, we can nevertheless trust them and so believe what they say – choosing to give them the benefit of the doubt. This is particularly notable when the person is a friend, or someone we are close to. Towards such persons, we demonstrate a remarkable epistemic partiality. We can trust, and so believe, our friends even when the balance of the evidence suggests that what they tell us is false. And insofar (...) as belief is possible, it is also possible to acquire testimonial knowledge on those occasions when the friends know what they tell us. Trust is central to our social lives. We know by trusting what others tell us. We act on that basis, and on the basis of trust in their promises and implicit commitments. So trust underpins both epistemic and practical cooperation and is key to philosophical debates on the conditions of its possibility. It is difficult to overstate the significance of these issues. On the practical side, discussions of cooperation address what makes society possible—of how it is that life is not (...) a Hobbesian war of all against all. On the epistemic side, discussions of cooperation address what makes the pooling of knowledge possible—and so the edifice that is science. But trust is not merely central to our lives instrumentally; trusting relations are themselves of great value and, in trusting others, we realize distinctive forms of value. What are these forms of value, and how is trust central to our lives? These questions are explored and developed in this volume, which collects fifteen new essays on the philosophy of trust. They develop and extend existing philosophical discussion of trust and will provide a reference point for future work on trust. (shrink)

As sources of knowledge, perception and testimony are both vulnerable to sceptical arguments. To both arguments a Moorean response is possible: both can be refuted by reference to particular things known by perception and testimony. However, lies and dreams are different possibilities and they are different in a way that undercuts the plausibility of a Moorean response to a scepticism of testimony. The condition placed on testimonial knowledge cannot be trivially satisfied in the way the Moorean would suggest. The child directed speech of twelve English‐speaking motherswas analyzed in terms of utterance‐level constructions. First, the mothers' utterances were categorized in terms of general constructional categories such as Wh‐questions, copulas and transitives. Second, mothers' utterances within these categories were further specified in terms of the initial words that framed the utterance, item‐based phrases such as Are you …, I'll …, It's …, Let's …, What did … The findings were: (i) overall, only about 15% of all maternal utterances had SVO (...) form (most were questions, imperatives, copulas, and fragments); (ii) 51% of all maternal utterances began with one of 52 item‐based phrases, mostly consisting of two words or morphemes (45% began with one of just 17 words); and (iii) children used many of these same item‐based phrases, in some cases at a rate that correlated highly with their own mother's frequency of use. We suggest that analyses of adult–child linguistic interaction should take into account not just general constructional categories, but also the item‐based constructions that adults and children use and the frequency with which they use them. Faulkner argues that Kofman's work on Nietzsche can be understood as autobiographical, in that it served to mediate a relation to her self. Faulkner examines this relation with reference to Klein's model of the child's connection to its mother. By examining Kofman's later writings on (...) Nietzsche alongside her autobiography, this article contends that Kofman's defense of anti-Semitism in Nietzsche serves to fend off her own ambivalence about being Jewish. (shrink)

He addresses the questions of what makes it reasonable to accept a piece of testimony, and what warrants belief formed on that basis. Much of the debate about identity in recent decades has been about personal identity, and specifically about personal identity over time, but identity generally, and the identity of things of other kinds, have also attracted attention. Various interrelated problems have been at the centre of discussion, but it is fair to say that recent work has focussed particularly on the following areas: the notion of a criterion of identity; the correct analysis of identity over time, and, in particular, the disagreement (...) between advocates of perdurance and advocates of endurance as analyses of identity over time; the notion of identity across possible worlds and the question of its relevance to the correct analysis of de re modal discourse; the notion of contingent identity; the question of whether the identity relation is, or is similar to, the composition relation; and the notion of vague identity. A radical position, advocated by Peter Geach, is that these debates, as usually conducted, are void for lack of a subject matter: the notion of absolute identity they presuppose has no application; there is only relative identity. Another increasingly popular view is the one advocated by Lewis: although the debates make sense they cannot genuinely be debates about identity, since there are no philosophical problems about identity. Identity is an utterly unproblematic notion. What there are, are genuine problems which can be stated using the language of identity. But since these can be restated without the language of identity they are not problems about identity. (For example, it is a puzzle, an aspect of the so-called “problem of personal identity”, whether the same person can have different bodies at different times. But this is just the puzzle whether a person can have different bodies at different times. So since it can be stated without the language of personal “identity”, it is not a problem about identity, but about personhood.) In the present study we analyse a sample of Irish Child Directed Speech in terms of item-based constructions and the communicative intents which they express. The study is based on the speech of an Irish native speaker engaged in daily activities with her son (aged 1;9). The findings of the analyses indicate the high degree of lexical specificity attested in the sample; in total 35 item-based frames account for just under 70% of analysed utterances. In most cases there was a (...) one-to-one relationship between item-based frame and communicative intent. However, of particular interest was the clustering of structurally related frames around specific functions. We propose that this relationship highlights the role of communicative intent in the organisation of structural linguistic knowledge. (shrink)

Professor Brown describes and criticises the major classical model of rationality and offers a new model of this central concept in the history of philosophy and of science.

The principle of informed consent, codified in the Declaration of Helsinki, has been widely seen as fundamental to bio-medical and research ethics. The importance of informed consent is increasing in procedures regulating the acquisition, possession and use of personal information, including genetic and medical information. Informed consent, it is believed, ensures that patients and research subjects can decide autonomously whether to permit or refuse actions that affect them. In response to this assurance, there are numerous guidelines at local, national and (...) international levels that recognise the importance of informed consent, especially in research related to healthcare in developing countries. However, complications arise in applying these guidelines to a particular situation, especially under conditions that are prevalent in developing societies, for instance in India. This article discusses common forms of impediments or hindrances encountered while exercising the principles of informed consent in the context of genetic and genomics related research among the tribal and rural caste communities in India. These hindrances include: illiteracy, poverty, paternalistic attitudes, socio-cultural barriers, ineffective regulatory mechanism and procedural inconsistency among others. The data used in this article is based on an ethnographic study conducted between December 2006 and May 2007 using social-science qualitative research techniques. We observe that three areas require attention: first, the ways in which informed public debate on bioethical issues can be held, and how the application of genetics and genomics in Indian society can be discussed; second, the readiness with which researchers, IRB members and the state appreciate and wish to map the genetic diversity in Indian society; and, third, the risks associated with the application of bioethical principles at a micro-level. Through communication, we form beliefs about the world, its history, others and ourselves. A vast proportion of these beliefs we count as knowledge. We seem to possess this knowledge only because it has been communicated. If those justifications that depended on communication were outlawed, all that would remain would be body of illsupported prejudice. The recognition of our ineradicable dependence on testimony for much of what we take ourselves to know has suggested to many that an epistemological account of testimony (...) should be essentially similar to accounts of perception and memory. During the 1992–1993 academic year, Harold Garfinkel offered a graduate seminar on Ethnomethodology in the Sociology Department at the University of California, Los Angeles. One topic that was given extensive coverage in the seminar has not been discussed at much length in Garfinkel’s published works to date: Aron Gurwitsch’s treatment of Gestalt theory, and particularly the themes of “phenomenal field” and “praxeological description”. The edited transcript of Garfinkel’s seminar shows why he recommended that “for the serious initiatives of ethnomethodological (...) investigations […] Gurwitsch is a theorist we can’t do without”. Garfinkel’s ethnomethodological “misreading” is not a mistaken reading, but is more a matter of taking Gurwitsch’s phenomenological demonstrations of Gestalt contextures in phenomenal fields and transposing them for making detailed, concrete observations and descriptions of organizationally achieved social phenomena. Where Gurwitsch addresses the organization of perception as an autochthonous achievement, inherent to the stream and field of individual consciousness, Garfinkel extends and elaborates this field into the social world of enacted practices. The April 1993 seminar also is rich with brief asides and digressions in which Garfinkel comments about his use of Alfred Schutz, his attitude toward publishing, his relationship with Erving Goffman, and many other matters. Another title in the reissued Oxford Classic Texts in the Physical Sciences series, Jeffrey's Theory of Probability, first published in 1939, was the first to develop a fundamental theory of scientific inference based on the ideas of Bayesian statistics. His ideas were way ahead of their time and it is only in the past ten years that the subject of Bayes' factors has been significantly developed and extended. Until recently the two schools of statistics were distinctly different and set apart. (...) Recent work has changed all that and today's graduate students and researchers all require an understanding of Bayesian ideas. This book is their starting point. (shrink)
